If any products arrive damaged or broken, or part of your order is missing, you must notify the Company within 2 days of delivery.

Shipping Policy:
- Shipping Options- Grass Root Essentials has partnerships with multiple carriers including FedEx, UPS and USPS Priority to best serve our customers. Depending on the location of the shipment, Grass Root Essentials will select the best and fastest possible shipping service for your location. (PO BOX delivery addresses will ship with USPS Priority). Please note: As a result of the COVID-19 pandemic, our ability to ship overnight has become severely limited. When possible, we will return to our normal shipping practices which will allow customers the option to upgrade delivery service to Overnight for a fee. In those instances, Grass Root Essentials will ship out with either FedEx or UPS.
- Packaging- corrugated boxes, bubble mailers, die-cut mailer, pack mailers, bubble wrap, feeder paper. During summer months and when orders contain heat sensitive items, the delivery package may contain foil insulations and a gel ice pack.
- Processing timeframe: 2-3 business days from time payment is processed.
Arbitration:
Any controversy or claim arising out of or relating to your purchase or these terms and conditions, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Limitation of Liability
GRASS ROOT ESSENTIALS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR PRODUCTS.

All Program design, text, graphics, logos, images, titles, phrases and product names and the copyrights, trademarks, and/or other intellectual property in such materials are owned by Grass Root Essentials and may be registered in the United States and internationally.
No Warranty
Grass Root Essentials and each of its subsidiaries and affiliates, along with each such entity’s respective officers, directors, employees, and agents make no warranty, express or implied, including but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to the Program or any products or services related to such Program.
Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida and any dispute shall be subject to binding arbitration in Brevard County, Florida. If any provision of this Agreement shall be found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
Class Action Waiver
You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.
The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding or claims (such as a class action, consolidated action or private attorney general action) unless all relevant parties specifically agree to do so following initiation of the arbitration. If this Class Action Waiver clause is found to be illegal or unenforceable, this entire Provision will be unenforceable, and the dispute will be decided by a court.
Ineligibility for Other Discounts or Promotions
Participants in the Grass Root Essential Preferred Members are given specific discounts and benefits based on their agreement with Grass Root Essentials. Participants may not combine preferred membership discounts or promotions with other discounts, promotions or other benefits available to other customers of Grass Root Essentials.
Changes to the Preferred Membership 90 Day Plan
Grass Root Essentials has the right to change the rules of the Preferred Membership Plan at any time and for any reason or no reason. Changes may include limits on order size or frequency, the addition or removal of benefits such as free shipping, eligibility in other Grass Root Essential programs such as other rewards programs, and other rules.
